Terms of Use

1. Acceptance of Terms

By accessing or using the SmashR platform ("Platform"), including the mobile application and website (getsmashr.com.au), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Platform.

SmashR reserves the right to modify these Terms at any time. Continued use after changes constitutes acceptance. We will notify users of material changes via email or in-app notification.

2. Eligibility

  • You must be at least 18 years of age to create an account and use the Platform
  • You must confirm your age when creating an account; accounts found to belong to persons under 18 will be closed
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials

3. Platform Description

SmashR is a marketplace connecting players, session organisers, and venue owners for racket sports (badminton, tennis, pickleball, padel, squash, and pop tennis) across Australia. SmashR facilitates bookings and payments but is not a party to transactions between users.

4. User Accounts and Roles

4.1 Players

  • May browse, book, and attend sessions and tournaments
  • Must accurately represent their skill level
  • Must arrive at booked sessions on time or cancel within the cancellation window
  • Are responsible for their own physical fitness and health; participation is at own risk

4.2 Organisers

  • May create and manage sessions and tournaments on the Platform
  • Must complete identity verification (KYC) through Stripe before publishing a paid session or receiving any payment
  • Are responsible for accurately describing sessions including location, time, skill level, and capacity
  • Must provide a safe and fair environment for all participants
  • Are responsible for ensuring appropriate venue permissions and insurance
  • May upload up to 5 photos per session. Photos must not contain phone numbers, email addresses, links, or QR codes. The organiser is responsible for obtaining the consent of any identifiable person appearing in a photo, and must remove a photo promptly if that person asks

4.3 Venue Owners

  • May list courts and facilities on the Platform
  • Must ensure listed facilities are safe, properly maintained, and accurately described
  • Are responsible for complying with local regulations and obtaining necessary permits

5. Bookings and Payments

5.1 Session Bookings

  • All bookings are confirmed upon successful payment
  • Session prices are set by the organiser
  • A booking fee is added to the session price. The full amount you will pay — session price plus booking fee — is displayed before you confirm payment
  • Payments are processed securely via Stripe

5.2 Fee Structure

The price you pay for a booking is made up of:

  • Session price: set by the organiser
  • Booking fee: SmashR's fee for providing the Platform. It includes our platform fee and the cost of card processing, and varies with the session price

The booking fee applies to every booking regardless of how you pay — it is not a card surcharge. The all-in total is always shown before you confirm payment.

5.3 Payments and Payouts

  • Participant payments are processed by Stripe directly into the organiser's own Stripe account. The organiser is the merchant for each session; SmashR never holds participant funds
  • SmashR automatically receives its platform fee from each transaction (included in the booking fee shown to participants)
  • Payouts from the organiser's Stripe account to their verified bank account run on Stripe's automatic schedule (the first payout to a new account may take up to 7 days; subsequently around 1–2 business days after each payment)
  • Refunds owed to participants, and any chargebacks and associated card-network fees, are drawn from the organiser's Stripe account balance (or recovered by Stripe from their nominated bank account)
  • Organisers are responsible for their own tax obligations (including GST registration and invoicing where applicable) in respect of amounts they receive

5.4 Pausing Payouts

This clause applies to organisers.

  • Payments for your sessions are made into your own Stripe account and paid out to you by Stripe on its normal schedule. SmashR does not hold your money.
  • Where we receive a credible report of fraudulent activity, or a dispute about your session remains unresolved, we may temporarily pause payouts from your Stripe account while we investigate. If we do this we will tell you the reason.
  • A pause lasts no longer than 14 days, after which payouts resume automatically unless we have notified you of a decision affecting your account.
  • Pausing payouts does not transfer your money to SmashR. The funds remain in your Stripe account throughout; they are only prevented from paying out to your bank while the pause is in force.

6. Cancellations and Refunds

6.1 Player Cancellations

  • Each session has a refund cut-off time set by the organiser. The cut-off is shown on the session before you book.
  • Cancel before the cut-off: the refundable amount — the session price — is refunded to your original payment method. The booking fee is not refundable, so you do not receive back the full amount you paid.
  • Cancel after the cut-off: no refund is payable and your payment is retained by the organiser.
  • Sessions marked “No refund”: some organisers set a session as non-refundable. Where they do, this is shown on the session and at checkout before you pay, and no refund is payable if you change your mind and cancel — at any time. This does not affect your rights below or under the Australian Consumer Law if the session is cancelled or materially changed.
  • If the organiser cancels the session, the session does not go ahead, or the organiser makes a material change to it (such as the time, date, or venue), you receive a full refund, including all fees.
  • Nothing in this clause limits any rights you may have under the Australian Consumer Law.

6.2 Organiser Cancellations

  • If an organiser cancels a session, all booked players receive a full refund
  • Repeated cancellations may result in account restrictions or suspension

6.3 Tournament Refunds

  • Each tournament has a withdrawal deadline shown before you register
  • Withdraw before the deadline: the refundable amount — the entry fee — is refunded to your original payment method. The booking fee is not refundable.
  • Withdraw after the deadline: no refund is payable
  • If the tournament is cancelled, or the organiser makes a material change to it (such as the date or venue), you receive a full refund, including all fees

7. Tournament Registration

  • Tournament registration is available exclusively via the SmashR mobile app
  • Registration is not available on the website or through third-party platforms
  • Players must agree to tournament-specific rules and regulations at the time of registration
  • Tournaments are conducted in accordance with the rules of the relevant sporting body (e.g., BWF for badminton), subject to tournament-specific exceptions

8. Code of Conduct

All users must:

  • Treat other users with respect and sportsmanship
  • Not engage in harassment, discrimination, or abusive behaviour
  • Not misrepresent their identity, skill level, or qualifications
  • Not use the Platform for any unlawful purpose
  • Not manipulate ratings, reviews, or session statistics
  • Comply with all applicable local, state, and federal laws

Violations may result in warnings, suspension, or permanent removal from the Platform.

9. Disputes

  • Disputes between users should first be raised through the in-app dispute system
  • SmashR will review disputes and may mediate, but is not obligated to resolve disputes between users
  • Chat history from sessions and tournaments may be retained for up to 90 days for dispute investigation
  • SmashR's decision on disputes regarding platform fees and refunds is final

10. Intellectual Property

All content, design, code, logos, and branding on the Platform are owned by SmashR. You may not copy, modify, distribute, or create derivative works without our written permission.

By posting content (reviews, profile information, session descriptions) on the Platform, you grant SmashR a non-exclusive, worldwide, royalty-free licence to use, display, and distribute such content in connection with the Platform.

11. Limitation of Liability

  • SmashR is a marketplace facilitator. We are not responsible for the quality, safety, or legality of sessions, tournaments, or venues listed on the Platform.
  • All participants play at their own risk. SmashR is not liable for any personal injury, loss, or damage arising from participation in sessions or tournaments.
  • SmashR is not liable for actions or omissions of organisers, venue owners, or other players.
  • To the maximum extent permitted by Australian Consumer Law, our total liability is limited to the fees paid by you to SmashR in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SmashR, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

13. Termination

  • You may close your account at any time through the app settings
  • SmashR may suspend or terminate accounts that violate these Terms
  • Upon termination, any pending bookings will be cancelled and refunded per our cancellation policy
  • Data retention after termination is governed by our Privacy Policy

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

15. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Where our liability cannot be excluded, it is limited to re-supplying the services or paying the cost of re-supply.
